DOES THE LENDER HAVE TO SUE ME TO COMPLETE A FORECLOSURE AGAINST ME IN ALABAMA?
No.  Alabama is a “non-judicial” state which means the lender does not have to (but can) file a lawsuit.  So the lender can foreclose without ever filing a lawsuit against you.  In some ways this is like the right of a lender to reposess a car – this can be done without involving the court system.
IS IT TOO LATE FOR SOMEONE TO HELP ME IF THE LENDER HAS STARTED FORECLOSURE PROCEEDINGS AGAINST ME SUCH AS ADVERTISING IN A NEWSPAPER?
Advertising in a local newspaper is normally done in Alabama for several weeks before the actual foreclosure sale occurs.  But whether you have been threatened with foreclosure or the sale is about to happen, you still have options.
WHAT IF THE FORECLOSURE SALE HAS ALREADY HAPPENED – CAN I STILL GET HELP FROM SOMEONE?
Certain options may no longer be available to you but others may still available.  For example, you may not be able to bring a “recission claim” to undo the loan but if you lost the house due to fraud on the part of the lender or servicer, then you can still sue for fraud and wrongful foreclosure if you are within the statute of limitations.  There are many possibilities and we will cover those in the seminar.

WHAT ARE SOME EXAMPLES OF WHERE A LENDER OR SERVICER HAS WRONGFULLY FORECLOSED?

One example is fraud on the part of the mortgage company.  A typical example is where the company promises you that if you make a certain payment by a certain date, the foreclosure proceedings will be cancelled.  You make the required payment on time and the company still forecloses.  We would analyze this situation under Alabama fraud law.

Another example is where the mortgage company does not follow its own Note or Mortgage but yet forecloses against you.  This often occurs with the “Notice” provisions that require the mortgage company to let you know if you are in default and to give you a definite date that you have to fix or “cure” the default.  If this is not given to you, we would analyze this situation under Alabama breach of contract law.

There are numerous other examples but these will give you an idea of what you may be facing when dealing with a mortgage company that wants you to follow the law but is unwilling to follow the law itself….
